New Haven High Capacity Well Ordinance
ORDINANCE NO. 2002-2
AN ORDINANCE PROHIBITING THE INSTALLATION OR OPERATION OF
HIGH CAPACITY WELLS WITHIN THE TOWN OF NEW HAVEN, ADAMS
COUNTY, WISCONSIN.
THE TOWN BOARD OF THE TOWN OF NEW HAVEN, ADAMS COUNTY,
WISCONSIN, DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Installation or Operation of High Capacity Wells Prohibited: Except
as provider herein, no person, or other legal entity shall install or operate a high capacity
well on any lands located within the Town of New Haven, Adams County, Wisconsin.
This section shall not apply:
a. To wells providing water exclusively for use of, or distribution by a
municipality.
b. To wells providing water used exclusively to irrigate agricultural lands, for
the production of crops, or for other agricultural purposes, on the lands on
which the well is located.
SECTION 2: Definitions:
a. "High Capacity Well", as used herein, shall mean any well, or any number
of wells on a single parcel of land, having a capacity to withdraw more
than 100,000 gallons of water per day.

b. "sinqle parcel of land", as used herein, shall mean the total of all
contiguous lands owned by the same owner(s), regardless of the size of
the parcel
SECTION 3: Penaltv: A person or other legal entity violating the provisions of this
ordinance shall be subject to a forfeiture of not more than $500.00 for each violation.
Each day during which a violation occurs shall constitute a separate violation.
SECTION 4: Effective Date: This ordinance shall be in full force and effect upon
passage and publication, as provided by law.

Wisconsin,at a regular Meeting of said Board conducted on the 2nd day of May, 2002,
by a vote of 2 for and 0 against.
