TOWN OF NEW HAVEN, ADAMS COUNTY, WI
Regular Monthly Town Board meeting of December 18, 2014-7:00 P.M.
The regular monthly Town Board meeting was called to order at 7:00 p.m. by Chairperson Julson with all board members present. Pledge of Allegiance was recited and this meeting was properly noticed in accordance with the Open Meeting Law. The agenda for this meeting was approved with a motion by Brad Luger/Lenny Watson. M/C. Minutes of the November 20, 2014 regular monthly town board meeting were reviewed and approved with a motion by Luger/Watson. M/C. The November 2014 financial report was read by the town clerk with the following balances as of November 30, 2014: NOW checking account-$27,584.26, Berry Ridge Parking Fees-$8,893.97, Tax account-Closed out, and Certificate of Deposit-$19,685.96.
PUBLIC COMMENT:
None at this time.
OLD OR UNFINISHED BUSINESS:
Chairperson Julson provided the town Attorney with a copy of the town’s ordinance regulating junked vehicles adopted in 1988. The ordinance limits the placement of unlicensed vehicles, without a permit, within 83 feet of the center line of a town road and a greater distance off of county and state highways. The ordinance did not apply, at all, to vehicles outside of that distance. It is of the town Attorney’s opinion that this ordinance is of limited value. The town’s 1988 ordinance is less restrictive than sec. 175.25 Wis. Stats. There were several options the town could entertain at this point: 1) enforce sec. 175.25, which only applies to the storage of automobiles and auto parts. 2) adopt a comprehensive public nuisance ordinance that would apply to a public nuisance of any kind. 3) pursue injunctive relief against the owners of properties on which public nuisances exist pursuant to chapter 823 Wis. Stats. This chapter allows the town to pursue a court order for the removal of the nuisance condition at the expense of the property owner, and that the costs of abatement can be added to the tax bill for the property as a special tax. If the town chose this option an ordinance is not specifically necessary as the town has authority under chapter 823 to pursue such action. This option could be the most time-consuming. A motion was made by Luger/Watson to use Chapter 823 Wis. Stats to start action with the property owners who pose a public nuisance of junk and abandoned unlicensed autos. M/C.
The Dells/Delton EMS contract was signed at $30 per capita, this contract will expire in June 2016, with a motion from Watson/Luger. M/C.
NEW BUSINESS:
A “blanket” highway permit for Adams-Columbia Electric Cooperative which allows services to be connected quickly in the area when there is not much advance notice given by a member, and the board not having to review every job. The town board gave their consent to this permit with a motion by Watson/Luger. M/C.
Motion by Luger/Watson to pay the Plan Commission members $250.00 and the Chairperson of the Plan Commission $1,000.00 in appreciation of their time and expertise, as these members don’t charge the town with any per diems from their meetings during the year. M/C.
In April 2014 the legislature adopted a law that set weight and length limits for Implements of Husbandry on farm machinery such as combines and agriculture commercial vehicles. It also allows local government officials to pass resolutions or ordinances regarding the maximum gross vehicle and axle weight limits for category B and all IoH and Agricultural Commercial Motor vehicles operating on roads under their jurisdiction. A motion was made by Luger/Watson to adopt option E which is one of six choices, opting in 348.15(9)(f)2.a. which requires the town to pass an ordinance requiring IoH and Ag CMV’s to follow the 23,000 and 92,000 weight table. Equipment or vehicles over that weight must obtain a no-fee permit from the town. The town is required to provide an approved alternate route. Appropriate signs must be posted. Ordinance # 01-2014 governing weight limits was signed by the town board, and will become effective and ongoing upon posting/ publication and posting on DOT website. M/C.
CHAIR OR COMMITTEE REPORTS:
Dale Reichhoff reported that he had attended the most recent Adams County Hwy. committee meeting at the highway department building concerning the proposed improvements for County Road P. It was the decision of the committee by a 3-2 vote to restructure some of the curves and intersections to make them safer. The road will be entirely taken up and materials added to the base and repaved rather than just an overlay.
Disbursements were read by the town clerk and approved for payment with a motion by Luger/Watson. M/C. Motion to adjourn at 7:40 p.m. by Luger/Watson until January 15, 2015 at 7:00 p.m. M/C.
