Ordinance Establishing Special Weight Limits on a 3rd Lane

Adams County
The Town Board of the Town of New Haven, Adams County, Wisconsin, has the specific authority under Statute 349.16, Wisconsin Statutes, to adopt this Ordinance.
This Ordinance, adopted by a majority of the Town Board on a roll call vote with a quorum present and voting and proper notice having been given, establishes the special weight limit as follows:
A. Imposition of Special Weight Limit:
A 12,000 pound weight limit shall apply to 3rd Lane from County G to County P. This section of Town Road is in need of additional protection due to special conditions and this ordinance is needed to avoid serious damage which could be caused in the absence of this special weight limitation. This special weight limit shall remain in effect until this ordinance is rescinded by the Town Board.
B. Exemptions From Special Weight Limitation:
Special Weight Limitation shall NOT apply to the following vehicles, which shall be exempt from all seasonal Weight Limitations:
(1) Septic Haulers complying with Wis. Stats. #349.16(3), which are traveling to destinations where they will be emptying tanks which are full or otherwise endanger public health and safety.
(2) Implements of Husbandry operating on such road in compliance with State law and Town Ordinance 11-2014.
(3) Milk Haulers which are picking up and transporting milk from dairy farms. Milk haulers shall use the shortest lawful direct route over town roads to and from dairies, and shall have the tag axle fully deployed, or this exemption does not apply.
(4) Highway Maintenance vehicles engaged in official duties, vehicles authorized by the Town to conduct snow and ice removal or public safety vehicles.
(5) Fuel Trucks and School Buses.
C. Signing: The Town Chairperson, or his or her designee, shall erect signs as required under #349.16(2) Wis. Stats., on or before the effective date of this ordinance.
D. Enforcement and Penalty: No person may operate any vehicle on the above-noted Town road in violation of the weight limit provided for in this ordinance without a written permit issued by the Town Board of the Town of New Haven issued under the permit procedure set forth in Town Ordinance 11-2014. Upon conviction for a violation of this ordinance, the violator shall pay a forfeiture of not less than $500.00 nor more than $1000.00, plus the applicable surcharges, assessments, and costs for each violation. Each trip in violation of this ordinance constitutes a separate offense. In addition, the Town Board may seek injunctive relief from a court of record to enjoin further violations.
E. Severability: If any section, clause, provision, or portion of this Ordinance is adjudged unconstitutional or invalid by a court of competent jurisdiction, the remaining provisions shall not be affected and the charge may be amended to a violation of Wis. Chapter 348.
This Ordinance shall be effective upon posting and publication as provided by law. Further, with the adoption of this ordinance, Ordinance #9-15, which in error referred to 3rd Avenue is hereby repealed.
